Effective date: 16 October 2026
Operator: Based App Pte. Ltd. (UEN: 202646548M), Singapore ("Based", "we", "us", "our")
Contact: getbasedapp@gmail.com
1. About these Terms
These Terms of Service ("Terms") are a legal agreement between you and Based. They apply when you use the Based mobile app and any related services (together, the "App").
By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
Some sections apply to everyone. Some apply only to:
- Customers: people who browse shops and place orders.
- Shop Owners: people who register a business on the App and sell through it (a "Shop").
2. What Based is (and is not)
Based is an online marketplace that helps people in Singapore find and order from home-based businesses, such as home bakers.
Based is a platform, not the seller. When you place an order, your contract of sale is directly between you and the Shop. Based does not make, own, store, inspect, prepare, package or hand over any product. We are not a party to the sale and we are not the Shop's agent, employer or partner.
This means the Shop, not Based, is responsible for its products, prices, descriptions, quality, safety, legality, pickup arrangements, cancellations and refunds (subject to the refund process in section 8).
3. Who can use the App
- You must be at least 18 years old, or have the permission and supervision of a parent or guardian who agrees to these Terms for you.
- To register as a Shop Owner you must be at least 18 and able to enter into a binding contract. If you register a Shop for a company or other business, you confirm you have authority to bind it.
- The App is intended for use in Singapore.
4. Your account
- You sign up with an email address and password. You may also add your name, phone number and a profile photo.
- Keep your information accurate and up to date.
- Keep your password private. You are responsible for activity on your account. Tell us straight away at getbasedapp@gmail.com if you think someone else has accessed it.
- One person per account. Do not create an account for someone else without their permission, or pretend to be someone else.
5. How ordering works
- Browse. Customers can browse Shops by area (Central, North, North-East, East or West) and category, view products, and save favourite Shops.
- Order. Add items to your cart, choose one of the Shop's pickup time options, and place your order. The order is a request to buy from the Shop.
- Order status. Orders move through these stages:
- Placed: you have sent the order to the Shop.
- Ready: the Shop has marked the order as ready to collect.
- Picked up: the order has been collected.
- Pickup only. There is no delivery. You collect your order in person at the Shop's pickup address. The Shop's full pickup address, including its unit number, is shown on your order once the order is ready.
- Chat. Customers and Shops can message each other in the App about orders.
Prices, stock levels and availability are set by each Shop and can change. A listing is not a guarantee that an item is available.
6. Payment
- Customers pay the full amount upfront when placing an order, using in-app PayNow payments through Stripe, which are being introduced. Your payment goes directly into the Shop's own Stripe account, not to Based. Payments are processed by Stripe, and Stripe's terms may also apply. Based does not store your bank details.
- Shops absorb the Stripe fee. It is deducted from the Shop's payout.
- Based is free for Customers.
- Shops pay Based a subscription. New Shops get a 30-day free trial, after which their chosen subscription plan begins. Current plans and prices are shown in the App before you subscribe. Based charges no commission on orders.
- If we change subscription prices or introduce any new fee, we will tell you at least 30 days before it applies and show it clearly in the App. A change will never apply to orders already placed. If you don't agree, you can cancel your subscription, stop using the App or delete your account.
7. Pickup and no-shows
Customers:
- Collect your order at the pickup time you chose. If you are running late or cannot make it, tell the Shop in the chat as early as you can.
- Respect the Shop's address. Many Shops are run from home. Use the address only to collect your order, arrive within the agreed time, and be considerate to neighbours.
- If you do not turn up and do not tell the Shop (a "no-show"), the Shop may cancel the order and may decline future orders from you. Repeated no-shows may lead us to restrict or suspend your account.
- Shops may set their own policies for uncollected orders (for example, how long they will hold an order). These should be shown in the Shop's listing or agreed in chat.
Shops:
- Have the order ready at the agreed time and mark it Ready in the App.
- Be available at the pickup address during the pickup times you offer.
- Mark orders Picked up once collected, so records stay accurate.
8. Cancellations and refunds
- Ask the Shop first. If there is a problem with an order, or you want to cancel it, contact the Shop through the in-app chat. The Shop may give a full or partial refund.
- If you can't agree, Based decides. If the Shop does not respond within 3 days, or you disagree with its answer, email getbasedapp@gmail.com. Based will review the order and make the final decision. That decision is binding on the Shop.
- Automatic refunds. If the Shop cancels an order, or never marks it Ready, you get a full refund automatically.
- How refunds are paid. Refunds go back through Stripe to the original PayNow source.
- Shop payouts. A Shop's payout for an order is held until the order is marked Picked up. Based may deduct refunds and chargebacks from a Shop's payouts.
Nothing in these Terms takes away any rights you have under Singapore consumer protection law.
9. Shop Owner responsibilities
If you register a Shop, you agree that:
9.1 Business details
- You will provide accurate business information: business name, pickup address, unit number, area, category, opening hours and pickup time options.
- Your street address and unit number are kept private. Your public shop page shows only your area or region. Your full pickup address, including your unit number, is shown only to the Customer who placed the order, once the order is ready.
- You will keep your opening hours, pickup times and stock up to date.
9.2 Accurate listings
- Each product listing must have an accurate photo, name, description, price and stock level.
- Photos must show the actual product (or a fair representation of it) and must be photos you own or have permission to use.
- Clearly state key information Customers need, such as size, quantity, and allergens and ingredients for food (for example nuts, dairy, eggs, gluten, shellfish), and whether products are halal-certified (only if they actually are).
- Do not use misleading claims, fake discounts or bait listings.
9.3 Food safety, licensing and the law
You are solely responsible for making sure your business and products comply with all applicable laws and rules in Singapore. These include, where relevant:
- Singapore Food Agency (SFA) requirements, including its rules and guidance for home-based food businesses, food safety and hygiene practices, labelling, and any licence needed if your business is not covered by the home-based exemption;
- the HDB and URA Home-Based Business Schemes (for example, limits on the type and scale of business, and not causing nuisance to neighbours);
- any rules for selling flowers, plants or other products (for example, NParks requirements where they apply);
- tax, business registration (ACRA), consumer protection and trading laws; and
- the Personal Data Protection Act 2012 (PDPA) in how you use Customer information (see 9.4).
Based does not check, verify or certify any Shop's licences, kitchens, products or compliance. We may ask you for proof of compliance and may remove listings or suspend a Shop if we have concerns.
9.4 Customer information
When a Customer orders from you, you will see their display name, order details and chat messages. You may use this information only to fulfil and communicate about that order. You must not use it for marketing, share it, sell it, or contact the Customer for unrelated purposes. You must keep it secure and dispose of it when you no longer need it.
9.5 Deactivating or deleting your Shop
- Deactivate: you can deactivate your Shop at any time. It will be hidden from Customers until you reactivate it.
- Delete: you can delete your business in the App. When you do, it is hidden from the App and marked as deleted. Some records (such as past orders) are kept so that Customers and Based have accurate order history and for legal, dispute and record-keeping reasons. See our Privacy Policy for details and for how to ask for further deletion.
- Before deactivating or deleting, please complete or cancel any open orders and let affected Customers know.
10. Prohibited items
Shops must not list or sell, and Customers must not order, any item that is illegal, unsafe or not allowed on the App. This includes:
- food prepared or stored in breach of SFA food safety rules, or food that is spoiled, contaminated or past safe use;
- alcohol, tobacco, vapes and e-cigarettes, and products containing them, including baked goods or desserts made with alcohol;
- medicines, supplements making health claims, controlled drugs or substances;
- weapons, fireworks or hazardous materials;
- live animals, or plants and plant products that are restricted or need a permit that the Shop does not have;
- counterfeit goods, or goods that infringe someone else's trademark, copyright or other rights;
- stolen goods;
- adult or sexually explicit products;
- anything that requires a licence the Shop does not hold; and
- services or items unrelated to the categories the App supports.
We may remove any listing at our discretion.
11. Acceptable conduct
When using the App, including chat and reviews, you must not:
- break any law or encourage anyone else to;
- harass, threaten, bully, stalk, abuse or discriminate against anyone;
- post hateful, obscene, violent, sexually explicit or defamatory content;
- share other people's personal information without their permission;
- send spam, advertising, chain messages or unrelated promotions;
- try to take payments or transactions off-platform in a way designed to defraud the other party;
- place fake orders, or orders you do not intend to collect;
- impersonate any person or business;
- upload viruses or harmful code, scrape the App, or try to access accounts, systems or data you are not allowed to;
- interfere with the App's operation or security; or
- use the App for any purpose other than its intended use.
12. Chat
- The chat is for communication about shops, products and orders.
- Be respectful and keep messages relevant.
- Do not use chat to share sensitive information (such as NRIC numbers, bank passwords or card details).
- We do not routinely read chats, but we may review messages when investigating a report, a safety concern or a breach of these Terms, or when required by law. See our Privacy Policy.
13. Reviews
Customers will be able to leave star ratings and reviews of Shops. Reviews show the reviewer's display name. When you leave a review:
- Review only Shops you have actually ordered from, based on your own genuine experience.
- Be honest and fair. Do not post false, misleading or defamatory reviews.
- Do not offer, accept or ask for payment, discounts or other rewards in exchange for reviews, and do not review your own Shop or a competitor.
- Do not include personal information (such as a Shop's unit number), offensive language or unrelated content.
Reviews are public to App users. We may remove or hide reviews that break these Terms, but we do not edit them and we are not responsible for what users say.
14. Content you post
"Content" means anything you add to the App, such as product photos, descriptions, profile photos, chat messages and reviews.
- You keep ownership of your Content.
- You give Based a non-exclusive, royalty-free, worldwide licence to host, store, copy, display, resize and adapt your Content only to run, improve and promote the App (for example, showing a Shop's product photo in the App or in our social media posts about the App). This licence ends when your Content is deleted from the App, except where it has already been shared or must be kept as described in our Privacy Policy.
- You confirm you have the rights to the Content you post and that it does not break any law or these Terms.
- We may remove any Content at any time if we believe it breaks these Terms or the law.
15. Our intellectual property
The App, including its name, logo, design and software, belongs to Based or its licensors. You may use the App for its intended purpose only. You may not copy, modify, reverse-engineer or redistribute it without our written permission.
16. Reporting a problem
To report a Shop, Customer, listing, review, message or safety concern, email getbasedapp@gmail.com with as much detail as possible. If something involves immediate danger or a crime, contact the police first. Food safety concerns can also be reported directly to the SFA.
17. Suspension and termination
By you:
- Customers can delete their account at any time in the App (see our Privacy Policy for the steps). This permanently deletes your profile and sign-in. Records of past orders remain with the Shops you ordered from.
- Shop Owners can deactivate or delete their Shop as described in section 9.5.
By us: we may warn you, remove Content, limit features, suspend or close your account or Shop, with or without notice, if:
- you break these Terms or the law;
- you repeatedly fail to collect orders or fulfil them;
- we receive complaints that we reasonably believe are valid;
- we need to protect users, the public or Based; or
- we are required to by law or by a government authority.
Where reasonable, we will tell you why. If you think we made a mistake, email us and we will review it.
Sections that by their nature should continue after termination (for example, 2, 8, 14, 18 to 21) will continue to apply.
18. The App is provided "as is"
We work hard to keep the App running and accurate, but we provide it "as is" and "as available". To the extent allowed by law, we do not promise that:
- the App will always be available, uninterrupted, secure or error-free;
- Shop information, listings, prices, opening hours, stock or reviews are accurate or complete; or
- any Shop or Customer will behave as expected.
We do not make any promise about the quality, safety, legality or fitness for purpose of products sold by Shops.
19. Limitation of liability
To the fullest extent allowed by Singapore law:
- Based is not liable for anything arising from the products a Shop sells or the dealings between Customers and Shops. This includes illness, allergic reactions, injury, loss or damage caused by products, food safety issues, incorrect listings, missed or late pickups, cancellations, refunds, or disputes. This does not affect the refund process in section 8.
- Based is not liable for any indirect or consequential loss, or loss of profit, revenue, business, goodwill or data.
- Based's total liability to you for all claims relating to the App is limited to the greater of (a) the total fees (if any) you paid to Based in the 12 months before the claim, or (b) S$100.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, or for fraud.
20. Your responsibility to us (indemnity)
You agree to cover Based for reasonable losses, costs (including reasonable legal fees) and claims made by others that arise because you broke these Terms or the law, or, for Shop Owners, from your products, your business or your dealings with Customers.
21. Governing law and disputes
- These Terms are governed by the laws of Singapore.
- If you have a concern about the App, please contact us first at getbasedapp@gmail.com so we can try to sort it out informally.
- If we cannot resolve it, the courts of Singapore (including the Small Claims Tribunals, where eligible) have exclusive jurisdiction.
22. Changes to these Terms
We may update these Terms from time to time, for example when we add features such as in-app payments or reviews, or when the law changes.
- We will post the updated Terms in the App (and on our website if we have one) with a new effective date.
- For important changes, we will give you reasonable notice, for example by in-app notice or email, before they take effect.
- If you keep using the App after the changes take effect, you accept the updated Terms. If you do not agree, you should stop using the App and may delete your account.
23. Apple App Store terms
If you downloaded the App from the Apple App Store:
- These Terms are between you and Based only, not Apple. Based, not Apple, is responsible for the App and its content.
- Your licence to use the App is limited to use on Apple-branded devices you own or control, as allowed by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation for the App, to the extent allowed by law.
- Based, not Apple, is responsible for handling any claims about the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- Based, not Apple, is responsible for investigating and dealing with any claim that the App infringes someone's intellectual property rights.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
24. General
- Whole agreement: these Terms and our Privacy Policy are the whole agreement between you and Based about the App.
- Severability: if any part of these Terms is found to be invalid, the rest still applies.
- No waiver: if we do not enforce a right straight away, we can still enforce it later.
- Transfer: we may transfer our rights and obligations under these Terms to another business, for example if Based is sold or restructured. You may not transfer yours without our consent.
- Third parties: except for Apple (section 23), no one else has rights under these Terms under the Contracts (Rights of Third Parties) Act 2001.
